Terms and Conditions of Service

Introduction

Welcome everyone who is interested in learning and developing themselves to the services of Fastlearn10x (Fast Learn Ten X). We are a Digital Learning Solutions Partner or partner for corporate customers in Thailand and Southeast Asia, focusing on bringing digital technology to enhance learning efficiency, allowing workers in the 21st century to access the knowledge necessary for work as quickly as possible to enhance readiness to deal with future challenges.

By registering to use the Fastlearn10x (FaslearnTenX) services, websites, software applications (collectively, the “Fastlearn10x Services” or this “Service”) or accessing any content or materials published by Fastlearn10x (FaslearnTenX) through this “Service”, you are entering into a binding agreement with Fastlearn10x (FaslearnTenX), the details of which are set out at the bottom of this document so that you understand the terms and conditions of your use of our services for the benefit of all of you.

Definition

The following words and expressions shall have the meanings set out below when used in these Terms and Conditions:
“Fastlearn10x (FaslearnTenX)” means the provider of online courses and other services. 
“User” means a person who logs into the Fastlearn10x (Faslearn Ten X) system to purchase services, try out the system, try out content, or use other Fastlearn10x (Faslearn Ten X) services.
“Member” means a user who has applied to be a member with Fastlearn10x (FaslearnTenX).
“Content” means the content accessible through the Service, which may be in the form of data, such as text, audio files, music, images, videos, software, programs, computer code, etc., and the like.
“Additional Terms and Conditions” means the documents issued or uploaded in connection with the Services, under the titles “Agreement”, “Guidelines”, “Policies” and the like.

Privacy Policy

“Users” can read and study the personal data protection policy at Privacy Policy Under the Privacy Policy, if the user wishes to delete any or all of the service usage data, they must notify Fastlearn10x (Faslearn Ten X) to request deletion of all user data. The user will not claim for products and services that were previously purchased from Fastlearn10x (Faslearn Ten X). The terms of this Privacy Policy will govern the use of all data collected while using the service.

Acceptance of Terms and Conditions

“Users” must agree to the Fastlearn10x (Faslearn Ten X) Terms and Conditions of Service before using any Fastlearn10x (Faslearn Ten X) services. Acceptance of such agreement is permanent and cannot be revoked.

Amendments to Terms and Conditions

Fastlearn10x (Faslearn Ten X) reserves the right to change the Terms and Conditions, as well as the Privacy Policy, without prior notice. Such changes are effective immediately on the date announced in the Terms and Conditions, Privacy Policy, or the Change Announcement. Users must follow the changes through the channels provided to Fastlearn10x (Faslearn Ten X) or on the website in the sections “Terms and Conditions of Service Fastlearn10x (Faslearn Ten X)” and “Privacy Policy”. It is not possible to claim ignorance. The Fastlearn10x (Faslearn Ten X) service will be used for personal learning purposes, which means the user or member himself. In addition, the user agrees not to copy, modify, or reproduce any part of the service content for business gain or financial support without permission from Fastlearn10x (Faslearn Ten X).

Subscription (Sign Up)

When the “User” registers with Fastlearn10x (Faslearn Ten X), it is considered that the User has given permission to collect information on the use of various services of the Service, including courses enrolled, system access, interest in various services, and other matters related to the Service. It is considered the right of Fastlearn10x (Faslearn Ten X) to use such information in accordance with the Personal Data Protection Policy without having to ask for permission. And the “User” will not have the right to access or request such information without receiving permission from Fastlearn10x (Faslearn Ten X) in terms of username and password.

In accessing the Fastlearn10x (Faslearn Ten X) service, the “User” is responsible for keeping it by themselves. Fastlearn10x (Faslearn Ten X) will consider that the person who logs in with the correct username and password from the correct login channel is the “User”. If there is a use or ordering of courses and services from Fastlearn10x (Faslearn Ten X), the User will not claim anything from others using the User’s username and password to log in to the system. The User must not allow other users to use the User’s member name or username, such as viewing content, etc., and will agree to cancel the certificate from the “Fastlearn10x (Faslearn Ten X)” system in its entirety and will not claim any compensation if found doing so.

Intellectual property rights

Fastlearn10x (FaslearnTenX) respects the intellectual property rights of instructors and partner institutions. All content in the communication channels, including but not limited to text, images, data, comments, diagrams, databases, graphics, photographs, images, audio or audio file formats, software, brand and HTML are the intellectual property of Fastlearn10x (FaslearnTenX) or partner institutions or users (as the case may be) and are protected by copyright and trademark laws and may not be downloaded, copied, modified, reproduced, printed or distributed in any form, except that you may download and/or print a copy of such content for your own legal and non-commercial use or other purposes. Instructors, course authors and Fastlearn10x (FaslearnTenX) reserve the right to suspend or terminate the accounts of users who infringe copyrights or trademarks or other intellectual property rights under the Copyright Act B.E. 2537 and amendments and other relevant intellectual property laws.

Scope of responsibility

The scope of liability of TERMS OF SERVICE shall not be greater than the amount paid by the “User” to purchase “goods” and/or “services” of Fastlearn10x (FaslearnTenX) only.

Cancellation of product use

The right to cancel the service will be subject to the conditions specified in the service only. If any service does not specify such matters, the conditions will be as follows:

1.) “Users” have the right to cancel orders that are incorrect from the system or the users themselves within 24 hours after agreeing to order, provided that the service usage does not exceed 1 in 10 of the services, counted according to the main content of the service, excluding other additional services.

2.) Cancellation of service: Users must notify Fastlearn10x (Faslearn Ten X) and follow the conditions set by Fastlearn10x (Faslearn Ten X) for service cancellation. If the “User” does not comply with or does not cooperate with the conditions, the cancellation of that service by the User will be considered void and the service cannot be cancelled, which will be permanent.

3.) Decline of a credit card payment or refund may result in you being charged a fee for that decline.

Payment and Invoice Information

Payment and invoice information will be subject to the terms and conditions specified in the service only. If any service does not specify such matters, the following terms and conditions will apply:

1.) “Users” will receive a receipt/tax invoice within 30 days after agreeing to purchase, with details according to the information you provided when ordering the product or making payment.

2.) “Users” who are companies or juristic persons have the right to edit the details of the receipt/tax invoice and request a refund of withholding tax within 3 days after agreeing to order or pay. They must contact…………………………….to notify their intentions and attach complete documents (Company Certificate/Por. 20/Withholding Tax Certificate/Copy of Bank Account Book/Payment Confirmation).

3.) “Users” who are companies or juristic persons will receive the withholding tax (if the amount has a fraction, it must be rounded down) by transferring the money back to the bank account specified by the users. The users must be responsible for the refund fee of at least 50 baht or the actual amount charged by the bank within 7 business days from the payment date. If it exceeds the specified time, Fastlearn10x (Faslearn Ten X) reserves the right not to refund the withholding tax. Documents for receiving money are as follows:

1. Payment confirmation
2. Withholding tax certificate
3. Power of attorney to receive money, along with a copy of the ID card of the grantor and the authorized person, signed (live)
